Texas uses a formula based on the paying parent’s net monthly income and number of children, up to an income cap set by the Family Code (the cap is adjusted periodically — confirm the current figure with the Attorney General’s office or your attorney). Below the cap, the standard guideline percentages of net monthly income are:

  • 20% for one child
  • 25% for two children
  • 30% for three children
  • 35% for four children
  • 40% for five children
  • Not less than 40% for six or more children

Different rules apply if you have children in more than one household, or if support is split or shared between parents — make sure the court knows about any other children you support. If a court believes you’re earning less than you’re capable of, support can be calculated based on your earning potential rather than your actual income.
