Texas Family Code §153.317: Alternative Beginning and Ending Possession Times
By default, the standard possession order uses fixed times (like 6 p.m.) for pickups and drop-offs. Section 153.317 lets a parent elect to instead tie certain exchanges to the school schedule — for example, weekend possession beginning when school lets out on Friday instead of a fixed evening time, or holiday possession beginning at school dismissal rather than a set hour.
This election covers weekend and Thursday periods during the school term, spring break, Christmas break, Thanksgiving, and Mother’s/Father’s Day weekends. It has to be made before or at the time the possession order is entered — either in writing filed with the court, or stated on the record in open court — so raise it with your attorney early if school-schedule-based exchanges would work better for your family than fixed clock times.
