FER’s position
Fathers for Equal Rights supports a legal presumption of equal physical custody in Texas — the idea that, absent clear and convincing evidence it wouldn’t serve the child, both parents should start from a level playing field rather than one parent needing to fight for equal time.
Why we support it
- Research consistently shows children generally do best with two actively involved parents.
- A level starting point reduces the incentive to use children as leverage in a custody dispute.
- It encourages parents to work out their own parenting plan rather than litigating over who “wins.”
Common objections, and our response
- “This is about avoiding child support.” It isn’t — support is a separate question from what custody arrangement best serves the child.
- “This is a gender issue.” The presumption is gender-neutral and applies equally regardless of which parent is seeking equal time.
- “This ignores domestic violence or abuse.” It doesn’t — those remain separate issues the court addresses independently, and can rebut the presumption where they’re proven.
