If your spouse forged your signature on a credit card or loan application without your knowledge, Texas law gives you a couple of paths to deal with it.

  • Contact the lender directly — they had a duty to verify the signature, and may correct the account once they know it was forged.
  • If the lender won’t release you from the debt, an attorney can pursue a negligence claim against them for failing to verify the application.
  • Raise a “fraud on the spouse” claim in your divorce — either actual fraud (deliberate deception) or constructive fraud (disposing of shared property without your knowledge or consent, which is easier to prove).

A successful fraud claim won’t necessarily erase the debt itself, but it can shift the property division in your favor to account for it. Raise this with your attorney as early as possible in the divorce.
